Terms of Service

By accessing or using No Shortfall ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

No Shortfall is a web application that allows users to record, organise, and manage personal and business assets, including photos, documents, purchase information, and valuations. The Service is provided on an "as is" and "as available" basis.

No Shortfall uses AI-powered features to assist with asset identification. These features are powered by third-party AI services including Anthropic's Claude models.

• AI-generated identifications are suggestions only and may be inaccurate, incomplete, or out of date.
• You are solely responsible for verifying any AI-generated content before relying on it for insurance, financial, legal, or any other purpose.
• We make no warranty as to the accuracy, reliability, or fitness for purpose of any AI-generated output.
• Images and text you submit for AI analysis are sent to Anthropic for processing in accordance with their privacy policy and usage terms.

• You are responsible for maintaining the confidentiality of your account credentials.
• You must not upload content that is illegal, harmful, or infringes the rights of others.
• You must not attempt to reverse-engineer, disrupt, or misuse the Service.
• You are solely responsible for the accuracy and completeness of data you enter.

Your data is stored using industry-standard cloud infrastructure including Supabase (PostgreSQL database) and Vercel (hosting and file storage). While we take reasonable steps to protect your data, no system is completely secure and we cannot guarantee absolute security.

You are responsible for maintaining your own backup copies of any data you consider critical.

To the fullest extent permitted by law, No Shortfall and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data, revenue, or profits
• Errors or inaccuracies in AI-generated content
• Service outages or interruptions
• Unauthorised access to your account or data
• Any reliance placed on asset valuations or identifications provided by the Service

Our total liability to you for any claim arising out of or relating to the Service shall not exceed the amount you paid us in the twelve months preceding the claim, or AUD $100, whichever is greater.

The Service is provided without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Asset valuations, AI identifications are provided for informational purposes only and do not constitute professional financial, insurance, or legal advice.

The Service integrates with third-party providers including Anthropic (AI), Supabase (database), and Vercel (infrastructure). Your use of the Service is also subject to the terms and privacy policies of these providers. We are not responsible for the acts or omissions of third-party services.

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. You may delete your account at any time from the Settings page.

We may update these Terms from time to time. We will notify you of material changes by updating the effective date above. Continued use of the Service after changes constitutes acceptance of the updated Terms.

These Terms are governed by the laws of Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Australia.
